A Dutch court ruling complicates Merck’s European rollout of under-the-skin Keytruda and strengthens Halozyme’s patent position. The existing intravenous treatment remains available, while Merck disputes the decision.

Merck’s push to expand its flagship cancer franchise has run into another patent barrier.

Halozyme said a Dutch court ordered restrictions on manufacturing and selling Merck’s under-the-skin Keytruda formulation in eight European markets, including France, Italy and the Netherlands. The existing intravenous treatment remains available.

The ruling complicates the rollout of a formulation designed to make treatment quicker and more convenient. For Merck shareholders, delays could limit an important avenue for extending the franchise’s commercial strength.

Halozyme gains a stronger position in its patent dispute, although a legal victory does not automatically translate into new revenue.

Merck strongly disagrees with the decision and disputes the patent’s validity. Investors should watch how the legal challenge develops and whether it changes the launch timetable or creates a path towards a commercial agreement.
